The KHL / NHL thing is strange since there isn’t a formal player transfer agreement in place between the leagues (like there is with, say, SHL). Nikishin could technically just walk away from his KHL deal and nothing would bar him from signing in Carolina, other than the league rejecting the contract (the NHL has bigger and broader factors to consider). Malkin left his deal early to join the Penguins. Miroshnichenko terminated his KHL to sign with Capitals. But had to forecast what it would take without knowing what sort of outs are included in Nikishin’s deal (NA agents don’t have access to KHL contracts…the transfer agreement with other leagues provides this information)
