I believe there is a rule against that. I can't recall exactly, but I'll check later.
Edit: Sorry, I can't find specific documentation. I know players have the right to participate and can't be suspended without cause, which is essentially what this would be, but the only thing publicly displayed is vague NHLPA player rights.
Such as you can't discriminate against a player and presumption of innocence.
All I can say for sure is that Kane not being permitted to at least attend practices with a team (not necessarily the Sharks), would lead to a grievance being filed (which he would win).
I dare say that even if he were sent to the minors and healthy scratched every game, he would have a case for discrimination, but that's speculative on my part (though I'd argue it's common sense).
