I feel like you're just bitter that Tampa is above the cap. If they get caught cheating and they have to revoke their title this year, I understand. Have they been cheating? No!

He was healthy enough to practice , he was healthy enough to Activate.
TBL took advantage of a situation hoping to capitalize

It was against the spirit of the rule and they'll be punished
When teams started signing mega contracts like Weber's
The league implemented the Recapture Penalty to make sure the trend ended.

NHL will be forced to do this
TBL will be called Cheaters who got away with it
A Rule will have been made because of them like Koavlchuk and they'll become a cautionary tale.

Even if they win
They're tarnishing this cup and by proxy over time people will forget the details and just assume
That's the only way they could win with this core whether its true or not , People remember Scandal longer then Reality

Remember that Tampa wasn't the only team to agree on the LTIR and cap deadline at the regular season. If this was the case for every team, then only 5 teams (Boston, Minnesota, Nashville, Florida, and Carolina all teams who aren't in the playoffs) would be under the cap and the playoffs would look very different. The NHL would most likely make some changes to this at the end of the season. Even if the league knew Tampa was cheating, then they definitely would have done something about it halfway through the postseason.

No they won't the league knows that Tampa circumvented the cap, the owners know Tampa circumvented the cap the whole hockey world knows they circumvented the cap. The problem is they have little to no way of proving it because the league does not require injured players to see a league doctor.

First where did I say I had a problem? All I said was everyone and their dog knows that Tampa circumvented the cap but the league lacks the ability to prove anything.

Cap circumvention is a rule that is broken and because of its vague wording it allows the league to enforce it as they wish. However they also need to be able to PROVE that the team circumvented the cap, in other words they need evidence. Right now as it stands they lack evidence against Tampa Bay or any other team that used LTIR as a way to gain cap flexibility. I believe that Montreal as well as a number of other teams also to a certain degree used LTIR to circumvent the cap this year. I think with such a wide range of teams doing this this year the league will be forced into making changes regarding the use of LTIR. I feel like the best way to curb such blatant circumvention would be any player being placed on LTIR must first see a league doctor then see the same league doctor periodically throughout his time on LTIR to determine his eligibility if the league doctor feels the player is no longer eligible for LTIR he will immediately be placed on the IR list and the team shall have 24 hours to become cap compliant otherwise the team will face cap circumvention penalties up to and including the forfeiture of the remaining regular season games.

NJD didnt break any rules signing Kovalchuk technically

A punishment called the "Re-Capture Penalty" was instead created
This was set to ensure those trying to play in the Grey area not only feel it but others will see the example that was made of them

Same thing will happen here
Its called Tactics and all you need is the backing of the Majority of Owners

Bitter, yes a little... Cheating, no.. Loophole exploited perfectly by J. Brisebois, absolutelly. Still, if TB win, it just look bad on how you can win a cup in a league where all the team you played against had a 81.5M limits and you had a 98.9M cap, it will ba a Stanley Cup that will be remembered for the the overcap situation and the Kucherov story more than the exeptional performance of a group of player.
