Description
Caufield probably takes Byron’s spot. I’d keep Byron with the team under this scenario though. At least for one more year. We’d have the cap space this year for sure.

Weber makes more money this way, so the NHLPA will support it.
Nashville accrued the cap benefit of the back diving contract, not Montreal, as such the recapture penalty falls with them. We traded for an existing contract. We didn’t create it. We will follow the CBA to the letter. Don’t like it? We don’t care. We’ll see you in court.

    But, the reality is this. Seattle cannot terminate a contract of any player taken in the expansion draft - mutual or not. It is an NHL rule for expansion. A player that is drafted in expansion must be on the team for at least a year. Furthermore, if Weber retires/terminated within the next two seasons, the recapture penalty will fall on both Nashville and the team owning his rights at the time. The only instance where the recapture penalty is solely on Nashville is after the 2022-23 season is completed.

    Seattle can’t buy anyone out, I agree. But a mutual contract termination is not a buyout.

    There is no possible recapture penalty for Montreal anymore. Rules were amended for Nashville last year:

    Thanks for the update on recapture penalty. I wasn't aware that had been amended by the league.

    And, you are right, a mutual termination is not a buyout. But I just don't see Weber accepting that. I think that if he felt he could still contribute, he'd just play out the contract. Not sure he would voluntarily agree to a termination then resign for 5 yrs to make his money back. Best scenario for Habs is that he can still be effective next two years and for the last three of his contract becomes a player/coach. Whenever he doesn't dress, he becomes the defense coach on the bench. That way, Habs maximize is health/effectiveness on the ice while keeping the veteran presence in the room.

    If Weber’s primary goal is to win a cup, then an extra $5mm in cap space for the team either should be incentive enough. He’d actual make more money too. Not sure where the downside would be.
